These MCP Server Terms of Use (the “MCP Terms”) are entered into between Detectify AB (“Detectify”) and the entity or person agreeing to these terms (“Customer” or “You”). These MCP Terms govern Your access to and use of the MCP Server and forms part of the parties’ existing agreement governing Your use of Detectify’s Services (the “Agreement”), including the Detectify Terms of Use. Capitalized terms not defined in these MCP Terms have the meaning set out in the Agreement and Detectify Terms of Use: https://detectify.com/terms-of-use.
1. BACKGROUND AND DEFINITIONS
1.1 “AI” and/or “AI system”. Artificial Intelligence (“AI”) and/or “AI System” are terms within the meaning of and as defined in the EU AI Act.
1.2 “EU AI Act”. The EU AI Act means the European Union’s Artificial Intelligence Act - Regulation (EU) 2024/1689.
1.3 “MCP Server”. Detectify offers a Model Context Protocol (MCP) server. MCP is a standard protocol that is built in order to expose tools to AI agents inter alia to query data but can be used both by humans and AI agents.
2. CUSTOMER RESPONSIBILITIES
2.1 You are responsible for your AI agents’ actions and/or omissions and/or decisionmaking.
2.2 Detectify’s Terms of Use Section 4 including Acceptable Use Policy remain applicable, and You are responsible for ensuring that these are not breached by You and/or your AI agent.
2.3 You are responsible for any potential copyright abuse and/or breach by your AI agent.
2.4 You are responsible for ensuring your AI agent acts within the scope/parameter of its intended purposes.
2.5 You are responsible for ensuring that no Prohibited AI within the meaning of EU AI Act is used by You or your AI agent.
2.6 You are responsible for ensuring that any High Risk AI within the meaning of the EU AI Act follows the applicable regulatory framework, safeguards and rules by You and/or your AI agent.
2.7 By opting in and agreeing to using the feature of MCP Server, You acknowledge that your AI agent will be using the resources provided to You and therefore You are responsible for limiting the incurred costs exceeding Your threshold by Your AI agent.
2.8 You shall: (a) treat all Credentials as Detectify Confidential Information, (b) restrict access to personnel with a need to know, (c) implement reasonable safeguards to prevent unauthorized use, and (d) notify Detectify without undue delay if You suspect any compromise or misuse.
2.9 You represent and warrant that You hold all necessary authorizations, approvals, and permissions necessary for lawful use of the MCP Server including the data used.
3. WARRANTY DISCLAIMER
3.1 "As-Is". THE MCP SERVER IS PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND. DETECTIFY SPECIFICALLY MAKES NO WARRANTY THAT THE MCP SERVER SHALL BE FREE FROM DEFECTS OR INTERRUPTIONS OF USE OR THAT IT WILL BE 100% SUCCESSFUL.
3.2 “BETA”. PLEASE NOTE THAT MCP SERVER IS CURRENTLY A BETA PRODUCT.
4. LIMITATION OF LIABILITY
4.1 Limitation of Liability. Limitation of Liability is as set out in the Detectify Terms of Use: https://detectify.com/terms-of-use.
5. GENERAL PROVISIONS
5.1 Governing Law. These MCP Terms shall be governed by the substantive laws of Sweden. Disputes shall be settled by arbitration administered by the Arbitration Institute of the Stockholm Chamber of Commerce (SCC).
5.2 Precedence. If there is any conflict between these MCP Terms, Detectify Terms of Use, and the Agreement, these MCP Terms prevail solely with respect to the MCP/MCP Server.
5.3 MCP Terms. These MCP Terms govern the specific use by You of the MCP Server. In all other aspects between the parties the Agreement and the Detectify Terms of Use shall complement these MCP Terms.
5.4 Opt-Out. You may at any time opt out of using MCP Server by switching off the feature and opting out directly in the Application. In case of any issues, please contact support@detectify.com
5.5 Termination. Termination rights with regard to the Agreement are set out in the Agreement and Detectify Terms of Use.
5.6 Modification of the MCP Terms. Detectify may revise these MCP Terms, of which the current version will be available on Detectify’s website. The revised MCP Terms become effective once made available on the website. Detectify will notify its customers of any major changes to the MCP Terms, such as when Your rights and/or obligations will significantly change, in which case You will have the opportunity to object by contacting your Detectify customer contact, legal@detectify.com or by simply opting out of the service in the application. If you continue to use the MCP Server after a revision of MCP Terms has become effective, you agree to be bound by the revised MCP Terms.
MCP Server Data Processing
Purpose: For the purposes of authentication in MCP Server, the following provider is used as a data processor:
